Making and confirmation of Article 4 direction withdrawing Class MA permitted development rights in selected town centre locations

Class MA of the General Permitted Development Order 2015 relates to change of use from Commercial, Business and Service uses (Use Class E) to residential (Use Class C3).

On 29 July 2021, the council made a non-immediate Article 4 Direction withdrawing permitted development rights for ‘Class MA’ permitted development in selected town centre locations.

The Council consulted on the Article 4 Direction from 2 August to 27 September 2021 and, following consideration of the representations received, the direction was confirmed on 28 July 2022 to then come into force on 1 August 2022.

This Article 4 Direction applied to the Brixton Creative Enterprise Zone, which included Brixton town centre; Streatham town centre; Clapham High Street primary shopping area and nine office locations in and around Clapham High Street town centre; and the West Norwood/Tulse Hill primary shopping area. The areas covered by the direction were shown on the maps below.

This Article 4 Direction has now been modified as part of the directions made by the Secretary of State for Levelling Up, Housing and Communities.
