Flats damaged by water ingress on communal roof

02 December 2022

Your request

A number of flats in my building were damaged horrifically ( ceilings fallen completely through etc ) due to water ingress as a result of bad workmanship, by Mears ( Lambeth's then contractor) on 'our' communal roof last year. [10-12 Herne Hill London SE24 9QT]

I wish to know please,

 a) how many flats suffered as a result and

b) what was done to each,

  1. and when?

Our response

We have considered this request under the Environmental Information Regulations 2004.

a) We are unable to provide precise figures when these are five or less due to the risk that individuals will be identified, as we are required to protect their identity under the Data Protection Act

In such circumstances sections 40(2) and (3) of the Freedom of Information Act apply.  In this case, our view is that disclosure would breach the first data protection principle.

This states that personal data should be processed fairly and lawfully. It is the fairness aspect of this principle which, in our view, would be breached by disclosure. In such circumstances section 40 confers an absolute exemption on disclosure. There is, therefore, no public interest test to apply.

b) Please see summary below

b1) Additional rainwater pipes and hoppers added.

04/08/2021 Water ingress confirmed rectified by Mears
